Privacy Policy and Notice on the Processing of Personal Data

The online shop TCH13.MARKET Oleg Cherne, with web address https://tch13.market , owned by TCH 13 Ltd, UIC 206450757, operates in compliance with Bulgarian and European legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR) from 27 April 2016 on the protection of personal data.

This document sets out the rules for the collection, use and protection by the Seller of the confidential information (personal data) provided by the Buyer, hereinafter referred to as the “Policy”.

 

  1. General Terms

1.1. This Policy forms part of the “Terms and Conditions” document published and available on the Internet at: https://tch13.market/terms/ , as well as other agreements concluded with the Buyer, where this is explicitly stated in their terms.

1.2. Without obtaining consent for the processing of personal data, the Seller shall not carry out registration for webinars, in-person seminars, courses, remote and in-person programs, and shall also have the right not to accept prepayment or provide Information Services to the Buyer.

1.3. In the event of any disagreement with the terms of the Policy, the Buyer must cease using the Information Services or acquiring the Information Materials and must notify the Seller.

1.4. The Policy uses the following key terms:

  • Automated Processing of Personal Data – processing of personal data using computer technology;
  • Blocking of Personal Data – suspension of the processing of personal data (except where the processing is necessary for the clarification of personal data);
  • Personal Data Information System – the set of personal data in databases and the processing provided by information technology and technical means;
  • Depersonalization of Personal Data – actions which result in it being impossible to determine, without the use of additional information, the affiliation of personal data to a specific data subject;
  • processing of personal data – any act (operation) or set of acts (operations) performed with personal data with or without the use of automation tools, including the collection, recording, organisation, accumulation, storage, clarification (updating, alteration), retrieval, use, transmission (dissemination, disclosure, access), depersonalisation, blocking, erasure, destruction of personal data;
  • Operator – a public authority, a municipal authority, a legal or natural person, alone or jointly with other persons, organising and (or) carrying out the processing of personal data, as well as determining the purposes of the processing of personal data, the nature of the personal data subject to processing, the actions (operations) carried out with the personal data;
  • Personal Data – any information relating directly or indirectly to an identified or identifiable natural person (data subject);
  • Provision of Personal Data – actions aimed at disclosing personal data to a specific person or a specific group of persons;
  • Distribution of Personal Data – acts aimed at disclosing personal data to an indefinite number of persons (transmission of personal data) or at making personal data known to an indefinite number of persons, including disclosure of personal data in the mass media, publication on information and telecommunication networks or making personal data accessible in any way;
  • Destruction of Personal Data – actions which result in the impossibility of recovering the content of personal data in the personal data information system and/or which result in the destruction of the physical carriers of personal data.

 

  1. Subject of the Policy

2.1. This Policy sets out the obligations of the Seller not to disclose and to ensure the protection of the confidentiality of personal data provided by the Buyer at the request of the Seller, when registering on the Website and placing an order for the provision of Information Services to the Buyer or in the case of the purchase of Information Materials.

2.2 The Personal Data permitted to be processed under this Policy is Confidential Information and is provided by the Buyer by completing the registration form on the Seller’s Website and/or the online platform selected by the Seller to provide Information Services, by completing and submitting a survey to the Contractor by email, and by any other means provided by the Seller or by law, and may include:

  • Name, middle name, surname of the Buyer;
  • Buyer’s contact telephone number;
  • Buyer’s e-mail address;
  • Buyer’s place of residence;
  • Buyer’s postal code and address (for sending certificates, other documents, parcels);
  • Details of Information Services received to date;
  • Other data as requested by the Seller as part of the provision of Information Services.

2.3. Any other personal information not mentioned above (purchase history, browsers and operating systems used, etc.) is also subject to secure storage and non-disclosure, except as provided in clauses 4.2 and 4.3 of this Privacy Policy.

2.4. The security of personal data processed by the Seller shall be ensured by the implementation of legal, organizational and technical measures necessary to meet the requirements of Bulgarian legislation in the field of Personal Data Protection.

 

  1. Purposes for Buyer’s Personal Data Collection

3.1. The Seller may use the Buyer’s personal data for the following purposes:

3.1.1. Identify the Buyer included in the Seller’s customer base for the purpose of placing an order remotely with the Seller;

3.1.2. Providing the Buyer with access to the Seller’s personalized resources (websites, online platforms, personal account);

3.1.3. Establishing a feedback relationship with the Buyer, including for sending notifications, inquiries regarding the use of the Seller’s Website, online platforms, providing services, processing requests and orders from the Buyer;

3.1.4. Locating the Buyer to ensure safety and prevent fraud;

3.1.5. Confirming the accuracy and completeness of the personal data provided by the Buyer;

3.1.6. Creating an account on the Website for the provision of Information Services if the Buyer has consented to the creation of such account;

3.1.7. Notifying the Buyer of the status of the Order;

3.1.8. Processing and receipt of payments, disputing payment, determining eligibility for discounts, deferred payment and other Buyer benefits;

3.1.9. Providing the Buyer with effective customer and technical support when problems arise in relation to the use of the Website, online platforms and other resources as part of the provision of Information Services;

3.1.10. Provide the Buyer, with the Buyer’s consent, with up-to-date product information, special offers, pricing information, newsletters and other information on behalf of the Seller and/or the Seller’s partners;

3.1.11. Carrying out advertising activities, with the Buyer’s consent;

3.1.12. Providing the User with access to Buyer’s partner sites or services for the purpose of obtaining products, updates, and services.

  1. Methods and Time Limits for Processing Personal Data

4.1. The processing of the Buyer’s personal data shall be carried out without time limitations, by any lawful methods, including in personal data information systems using or not using automation tools, as well as through special websites, programs, aggregators of services for processing and storage of personal data.

4.2 The Buyer agrees that the Seller shall be entitled to transfer personal data to third parties for the purpose of arranging postal services, registration at sites with a pass-through regime, courier services, payment services, telecommunications operators solely for the purpose of fulfilling an order for the provision of Information Materials or the provision of Information Services to the Buyer. Where necessary, the Buyer shall have the right to give separate informed consent to such third parties in relation to his/her personal data.

4.3 The Buyer’s personal data may be transferred at the request of the authorized authorities in accordance with the applicable legislation of the Republic of Bulgaria and the European Union and in compliance with tax laws.

4.4. In the event of loss or disclosure of personal data, the Seller shall inform the Buyer of the loss or disclosure of personal data.

4.5. The Seller shall take the necessary organizational and technical measures to protect the Buyer’s personal data from unauthorized and accidental access, destruction, alteration, blocking, copying, dissemination, as well as from other unlawful actions of third parties. The Seller’s website uses an SSL (Secure Socket Layer) certificate, which provides encryption of the connection between a server (Website) and a browser (User). Information transmitted over such connection is protected from unauthorized access and interception.

4.6. The Seller, together with the Buyer, shall take all necessary measures to prevent damage or other negative consequences caused by the loss or disclosure of the Buyer’s personal data.

  1. Buyer’s rights regarding personal data

5.1. The Buyer, who has submitted his/her personal data to the Seller, independently decides on the provision of the personal data and consents to its processing freely, of his/her own free will and in his/her own interest. Consent to the processing of personal data may be given by the data subject or their representative in any form that allows to confirm the fact of receipt unless the legal framework provides otherwise.

5.2. Buyer’s rights as a data subject:

  • The Buyer has the right to obtain from the Seller information related to the processing of his/her personal data if this right is not limited in accordance with Bulgarian legislation. The Buyer shall have the right to require the Seller to correct their personal data, to block or destroy them if the personal data is incomplete, outdated, inaccurate, unlawfully obtained or not necessary for the stated purpose of processing, as well as to take the measures provided for by law to protect their rights;
  • The processing of personal data for the purpose of promoting goods, products, marketing services by making direct contact with the subject of these personal data (potential Buyer) by means of communication, as well as for the purpose of political campaigning, is only permitted with the prior consent of the data subject; 
  • The Seller shall immediately terminate, at the request of the data subject, the processing of their personal data for the above purposes;
  • It is prohibited to take decisions based solely on automated processing of personal data which produce legal effects concerning the data subject or otherwise affect their rights and legitimate interests, except in the cases provided for by Bulgarian law or with the written consent of the data subject;
  • If the Buyer believes that the Seller processes personal data in violation of the requirements of the Personal Data Protection Act or otherwise violates their rights and freedoms, the Buyer has the right to appeal the actions or inaction of the Seller to the authorized body for the protection of the rights of data subjects or in court.
  • The Buyer shall have the right to protect their rights and legitimate interests, including the right to compensation for damages and/or compensation for moral damages.

 

  1. Additional Terms

6.1. The Seller reserves the right to update or amend this Privacy Policy and Personal Data Processing to reflect any changes to the way it processes the Buyer’s personal data or changes to legal requirements.

6.2. The new Policy shall take effect from the time it is published on the Seller’s Website unless the new Privacy Policy wording provides otherwise.

6.5 The Buyer has the right to refuse to provide their personal data in whole or in part by sending a letter to shop@olegcherne.com . In this situation, the Buyer understands that in this case the Seller has the right to refuse to provide Information Services or to deliver Information Materials to the Buyer’s address.

 

Consent to the Processing of Personal Data

By acting freely, of their own free will and in their own interest, and by confirming their legal capacity, the individual gives consent to TCH 13 Ltd, UIC 206450757, to the processing of personal data under the following conditions:

  1. The registration on the Website https://tch13.market and/or the acceptance of the General Terms and Conditions https://tch13.market/terms/shall be deemed as consent.
  2. Consent to the processing of the following personal data:

2.1. Name, middle name, surname;

2.2. Contact phone number (mobile, landline);

2.3. Electronic address (e-mail);

2.4. Location;

2.5. Postal code and address;

2.6. Social networks (Facebook, Telegram, others)

2.7. Audio-, photo- and video-images in case of online recording of Information Materials, services.

  1. Purpose of the processing of personal data: providing information of an advertising nature about Information Services and materials of TCH 13 Ltd. by telephone, including by SMS, e-mail or other means of communication; creating new Information Services and Information Materials; improving the quality of Information Services and Information Materials.
  2. Consent is given to the processing of personal data, both without and with the use of automation means, by methods such as collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (provision, access), blocking, deletion, destruction.
  3. The following third parties process the personal data provided on behalf of TCH 13 Ltd.: Fozzy, Superhosting, Google Analytics, WordPress, Facebook Pixel.
  4. Personal data is processed until the termination of the Terms and Conditions or until the data subject or their representative withdraws their consent.
  5. In the event of a recording during the provision of Information Materials or Services (recording of an online seminar, etc.) in which the data subject can be identified, such data subject hereby gives his/her full informed consent to the alienation of such materials for the benefit of TCH 13 Ltd. and shall not have the right to request the removal of such materials from the Site, nor to request material remuneration for the use of such audio, photo or video images and materials.
  6. Consent may be withdrawn by the data subject or his or her representative by sending a written request to shop@olegcherne.comor via the Personal Account.
